Does the SAVE Act Stop Noncitizens from Voting?

The League of Women Voters is committed to informing voters about changes in voting rules.

The SAVE (Safeguard American Voter Eligibility) ACT, pending in the U.S. Senate, is based on mis- and disinformation and fear mongering about non-US citizens voting. It was proposed as a means of preventing noncitizens from voting. 

SAVE will require voters to provide documentary proof of citizenship in person to register to vote in federal elections. 

IS VOTING BY NONCITIZENS REALLY AN ISSUE?

A review of claims by the Center for Election Innovation and Research (CEIR) of noncitizen voting by states through Dec. 31, 2025, found that the alleged large numbers of noncitizen registrants or voters are a misleading overestimation.

  • It is illegal for noncitizens to vote in federal elections
  • Current, verifiable evidence indicates noncitizen voting is extremely rare. Between 1999 and 2023 the Bipartisan Policy Center documented only 77 cases of noncitizen fraud nationwide
  • There is no evidence that noncitizen voting has impacted election outcomes
  • Widespread noncitizen voting is unlikely because It is a crime punishable with fines, imprisonment, and deportation
  • Most states require voters to swear under oath to citizenship, subject to perjury, and verify voter registration status through social security and other databases

THE SAVE ACT IS NOT NECESSARY. It is a disastrous bill that will disenfranchise millions of American voters as it eliminates the many of the different options of voter registration that millions of citizens rely on: mail and online registration, registration at DMVs, and voter registration drives.
